ALERT: effective date for FTC ban on non-compete provisions or agreements

Hopefully you are aware that the FTC has issued a ban on non-compete agreements. (See our post on May 13, 2024, for more details.) The ban is not only prospective, but also retroactive. There are a few exceptions, but for the most part, it is all-encompassing. The ban is to take effect 120 days after it is published in the Federal Register. The FTC published it May 7, 2024, such that it will be effective September 4, 2024, unless halted by Court action. Contact us to discuss the effect of this ban on your business practices.
